Client - Refers to the purchaser of the land plot(s) as detailed on the Plot Reservation Form.
Site - refers to a place of land acquired by TPDL, and subsequently divided into a certain number of individual plots.
Land Plot - refers to an individual piece of land purchased by a client of TPDL.
Contract - refers to the legally binding contract between you and TPDL for the sale of the land plot.
We, us, our - refers to TPDL, registered address 201, Dyke Road, Hove, East Sussex, BN3 1TL.
1.1 TPDL are land dealers and claim no specialist knowledge or expertise as to the future prices of land and the likelihood of land being reclassified. We do not offer advice or speculate as to predicted land rises. Historical rises in the value of land are not a reliable guide to the future price of land. Whilst it is reasonable to predict that some greenbelt land will be reclassified in the future, this provides no guidelines or guarantees that land sold by TPDL will be of this type and no return can be guaranteed.
1.2 We will provide guarantee that land is freehold but we cannot guarantee that the price paid for any land plot represents its market value and it is up the clients to satisfy themselves independently of the value of any land purchased from us.
1.3 By using our service you are accepting our terms and conditions.
2.1 All land sold is freehold and TPDL have no future claims on the land whatsoever. The client becomes the legal owner of the land and all items upon and beneath it once cleared funds have been received by TPDL. Sometimes mineral rights may be excluded but this should not affect the future development.
3.1 Land may be purchased by telephone, post and on-line. Land is, by its very nature, limited in supply. Our offers are strictly limited and demand for these opportunities frequently exceeds supply. If your application is unsuccessful, TPDL will either offer an alternative or the return of your deposit.
3.2 TPDL searches the land registry and recent copies of the land registry title and Charges Register are available upon request.
3.3 TPDL maintain the right to retain a percentage of each site that is acquired; this ownership may be made up of a mixture of rights of way, access roads and land points.
3.4 Individual clients are responsible for any insurance that they may deem necessary for their land. TPDL will have public liability insurance for any land retained or unsold.
4.1 All land sold by TPDL is without planning permission and is purely agriculture, brown field, green belt or forestry land. The land plots are sold without prior planning permission. TPDL does not imply or state that any planning permission will be granted.
5.1 Transfer deeds in the form Land Registry TP1 or TR1 complete with forms SDLT1 and AP1; together with an addressed envelope to the Land Registry are supplied by TPDL.
6.1 A land plot is secured for a client by means of a deposit of 10% of the purchase price. The full balance is then due within fourteen days. Any client wishing to cancel, prior to payment of the balance, may do so but such deposit will be forfeited.
7.1 By signing the Plot Reservation Form the client confirms that they have read and accept these terms and conditions detailed herein and that the purchase of the land plot by the client is based solely upon the client's own inspection of the site, the land plot and the title documents and is not reliant upon any representation or warranty either written or oral or implied made by or on behalf of TPDL.
8.1 The client shall be deemed to purchase the plot with full notice and knowledge of all matters contained, mentioned or referred to in the title documents (whether inspected or not) and shall not raise any requisition or make any objection in relation to them.
8.2 TPDL shall have no liability for any statement made by any person or agent involved in the sale of any land plot unless they are set out in writing and signed by a director.
9.1 The contract between TPDL and the client will be governed by and interpreted in accordance with English Law.
